These terms and conditions outline the rules and regulations for the use of PlayHT Inc.'s Website, located at www.play.ai (https://play.ai)

By accessing this website, we assume you accept these terms and conditions. Do not continue to use Play.ai if you do not agree to take all of the terms and conditions stated on this page.

License

Unless otherwise stated, PlayHT Inc. and/or its licensors own the intellectual property rights for all material on play.ai. All intellectual property rights are reserved. You may access this from play.ai for your own personal or business use subjected to restrictions set in these terms and conditions.

Users may create accounts and AI agents on PlayAI for personal and business purposes. Users are responsible for maintaining the confidentiality of their account information and are liable for all activities conducted through their accounts.

Users can clone their voices and use them as their agent's voice. PlayHT Inc. is not responsible for the authenticity or legality of the cloned voices. Users must ensure that they have the right to use and clone the voices they upload to the platform.

Limitation of Liability

PlayHT Inc. is not responsible for any actions taken by the AI agents created on PlayAI, nor for any consequences resulting from the use of cloned voices. Users agree to indemnify and hold PlayHT Inc. harmless from any claims, damages, or expenses arising from their use of the platform and their AI agents.

Privacy Policy

PlayHT Inc. is committed to protecting the privacy of its users. We do not sell any user information. Our Privacy Policy, which is incorporated into these Terms and Conditions by reference, provides further details on how we collect, use, and protect user data.

Condition of Use

You agree to comply with the following conditions in using the Services.

You are solely responsible for all Content you submit to PlayAI. (When we say “Content you submit” and similar terms, we mean anything you seek to post, transmit, or share, including but not limited to text, images, sounds, video, graphics, information, or other data).

You agree not to submit any Content that:

  1. (i) infringes any intellectual property or other proprietary rights of any party;
  2. (ii) you do not have a right to submit;
  3. (iii) contains software viruses or any computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
  4. (iv) poses a privacy or security risk to any person;
  5. (v) constitutes unsolicited or unauthorized advertising, promotional materials, commercial activities and/or sales, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” “contests,” “sweepstakes,” or any other form of solicitation;
  6. (vi) is threatening, abusive, harassing, tortious, bullying, or excessively violent;
  7. (vii) is defamatory, libelous, or verifiably false with the purpose of harming others;
  8. (viii) constitutes hate speech that demeans or promotes discrimination or violence on the basis of race, ethnicity, gender, religion, age, or other social, physical or mental characteristics;
  9. (ix) is obscene or pornographic;
  10. (x) constitutes sexual harassment;
  11. (xi) constitutes sexual exploitation or abuse of a minor, including sharing child sexual exploitation or abuse imagery or content, grooming, or sexual extortion;
  12. (xii) glorifies self-harm, including self-injury, suicide, or eating disorders;
  13. (xiii) promotes terrorism or violent extremism;
  14. (xiv) increases or promotes criminal activity;
  15. (xv) seeks to buy or sell illegal drugs;
  16. (xvi) facilitates fully automated decision making that adversely impacts a person’s legal rights or creates a binding, enforceable obligation;
  17. (xvii) seeks to provide medical, legal, financial or tax advice;
  18. (xviii) interferes with or disrupts our services or servers or networks connected to our services, (xix) interferes with or appropriates any person’s right of publicity by using their name, likeness or persona (a) without permission and (b) outside a permissible context such as non-commercial parody or public commentary; or (xx) in the sole judgment of PlayAI, is objectionable or that restricts or inhibits any other person from using or enjoying the Services, or which may expose PlayAI or its users to any harm or liability.

You likewise agree not to do any of the following in connection with your use of our Services:

  1. (i) disobey any requirements, procedures, policies or regulations of networks connected to the Services;
  2. (ii) violate any applicable law or regulation;
  3. (iii) impersonate any person or entity, or misrepresent your affiliation with a person or entity;
  4. (iv) solicit personal information from anyone under the age of 18;
  5. (v) harvest or collect email addresses or other contact information of other users from the Services by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications;
  6. (vi) obtain or attempt to obtain any information through any means not intentionally made available or provided for through the Services;
  7. (vii) lease, lend, sell or sublicense any part of the Services;
  8. (viii) try to evade any technological measure designed to protect the Services or any technology associated with the Services; or (ix) reverse engineer, disassemble, decompile, decode, adapt, or otherwise attempt to derive or gain access to any Services source code, in whole or in part (unless a portion of code within the Services is released as open source and the open source license governing such code expressly permits reverse engineering, copying or other modification).

To the extent PlayAI chooses to support voice or audio features, you agree not to do any of the following in connection with your use of the Services:

  1. (i) submit voice recordings of third parties without their consent to engage in “deepfakes” or impersonation of any kind, including but not limited to those that create political misinformation, perpetrate frauds or scams, impugn the reputation of third parties, or otherwise amount to harmful conduct.

We reserve the right to investigate and take appropriate action against anyone who we conclude, in our sole discretion, has violated the provisions above. That action may include, without limitation, removing Content from PlayAI, suspending or terminating your account, and reporting you to law enforcement.

Changes to Terms and Conditions

PlayHT Inc. reserves the right to modify these terms and conditions at any time. We will notify users of any changes by posting the new terms and conditions on this page. Users are advised to review this page periodically for any updates.

Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of Delaware. Any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Delaware.
